The Supreme Court's Same-Sex Marriage Decision

Information from a trusted Maryland Family Lawyer

June 26, 2015, the Supreme Court ruled on four cases from four different states, all collectively known as "Obergefell." In their decision, they declared that in all four cases—and for all Americans—the Constitution guarantees the right of marriage. The decision legalized same-sex marriage nationwide and was instantly celebrated as a landmark civil rights victory.

For those in our LGBT community, the landscape of family law has now changed, even for Maryland same-sex couples who were married prior to Obergefell. At the Law Offices of Cricket Browne, LLC, our team has always brought an unwavering commitment to family law and divorce clients who come from both opposite-sex and same-sex marriages. Same-Sex Marriage in Maryland

Maryland legalized same-sex marriage in 2013. However, that was a state ruling that did not provide Maryland same-sex couples with federal marriage benefits. Now that there has been the decision on Obergefell, however, that has changed.

New federal marriage benefits for same-sex couples include:

  • Social security benefits
  • Federal employee benefits
  • Military (and veteran) benefits

These, along with some tax considerations, are just a few of the many ways a couple's financial circumstances might've changed since Obergefell. As with any financial matter, these benefits also have the potential to affect a family law case. For many, issues like child support, alimony, or even a pre-nuptial agreement may have to be reconsidered due to these benefits.
